EU/ITALY: ECJ rules on liqueur trademark battle

Insurer Says It Won't Pay If Amazon.com Loses IBM Lawsuit

Atlantic Mutual Insurance Company is asking a judge to free it from any responsibility to indemnify Amazon.com for losses should Amazon be found guilty of violating IBM's patents.

"Atlantic contends it is not obligated under its policies to provide a defense or to provide any indemnity to Amazon for the claims being asserted against it by IBM," attorneys for the insurer said in court papers filed last week in U.S. District Court for Eastern Texas -- the same venue hearing IBM's lawsuit against Amazon.com.

Atlantic Mutual maintains that the insurance policies it sold Amazon.com are limited to claims related to "advertising injury" and "personal injury." The insurer says the coverage for advertising injury extends to claims for copyright violation but not patent infringement.


ECONOMIC REPORT: U.S. Trade Gap Narrows Again In January

WASHINGTON (Dow Jones) -- The U.S. trade deficit narrowed again in January, adding to the sense that the trade gap has at least stabilized and may even be starting on a downward trend, a government report showed Friday. "Trade continues to be one of the bright spots in the economy," said Nariman Behravesh, chief economist at Global Insight. The nation's trade deficit narrowed by 3.8% to $59.1 billion, the Commerce Department said. This is the fourth narrowing of the deficit in the past five months. The size of the decline surprised analysts. Economists surveyed by MarketWatch had expected the deficit to narrow to $60.4 billion. December's trade deficit was revised slightly to $61.5 billion from the initial estimate of $61.2 billion. As a result of the revisions, for all of 2006, the U.S.


Third Wave Files Response to Digene Patent Suit, Files Anti-Trust ...

MADISON, Wis., March 1 /PRNewswire-FirstCall/ -- Third Wave Technologies Inc. (NASDAQ:TWTI) today announced that the company has filed its response to the recent patent lawsuit brought against it by Digene Corp. The company's answer to the suit was filed with the U.S. District Court for the Western District of Wisconsin in Madison, where it is being heard.

Third Wave's response includes counterclaims against Digene alleging that it has abused its monopoly power to thwart competition in the human papilloma virus, or HPV, diagnostic marketplace.

"Digene filed its patent infringement suit knowing that Third Wave's Invader(R) chemistry is superior to Digene's and does not infringe its patent, as our response asserts," said Kevin T. Conroy, president and chief executive of Third Wave.
